Rape & Murder: Correctional Facility Teacher Appeals Sentence

An attorney representing a former Topeka Correctional Facility employee Tuesday asked the Kansas Court of Appeals to block a Shawnee County judge's order requiring the one-time plumbing instructor to register as a sex offender for conviction of unlawful sexual relations with an inmate. John Fakhoury asked a three-judge panel to conclude District Judge Nancy Parrish inaccurately interpreted state law and evidence when instructing Anastacio "Ted" Gallardo to add his name to the registry. Gallardo got an inmate pregnant in 2007 and was convicted in a felony sex case in 2008. Gallardo quit his teaching job at the prison after learning Keith was pregnant. He smuggled drugs into the prison in an attempt to induce a miscarriage. After an inmate alerted the TCF staff of Keith's pregnancy, the corrections department facilitated an abortion in Johnson County. Gallardo was charged with rape, unlawful sexual relations and trafficking. He reached a plea bargain to avoid prosecution for rape. Parrish sentenced him to two years of probation, a fine of about $100 and inclusion on the registry.
